aftergum® Terms of Service

Welcome to aftergum® (“aftergum,” “we,” “our,” or “us”), operated by Aftergum Inc. These Terms of Service (“Terms”) govern your use of our website, products, and services. By accessing or using our website or purchasing our products, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or purchase our products.

1. Eligibility

You must be at least 18 years old to make a purchase from our website. By using our site or placing an order, you confirm that you meet this requirement.

2. Product Use and Safety

All aftergum® products are intended for personal, non-commercial use. Use only as directed on the product packaging. Chewing gum presents a choking hazard for young children; keep out of reach of children. Our products contain xylitol, which is toxic to dogs and other pets; keep products away from animals. We do not guarantee specific outcomes from using our products.

3. Orders and Payments

All orders are subject to acceptance and availability. We reserve the right to cancel, limit, or refuse any order for any reason, including suspected fraud or pricing errors. Prices are listed in U.S. dollars and are subject to change without notice. Payments are processed securely through our authorized payment providers. You agree to provide accurate, current, and complete billing and shipping information.

4. Subscriptions and Auto-Renewal

We offer optional subscription purchases (“Subscribe & Save”) through which products are automatically shipped and billed on a recurring basis at the frequency you select.

Automatic renewal. By enrolling in a subscription, you authorize us and our payment processor to charge your payment method on a recurring basis at the price and frequency displayed at checkout, plus any applicable taxes and shipping charges, until you cancel. Your subscription will automatically renew at the end of each billing cycle unless you cancel before the next scheduled billing date.

How to cancel or modify. You may cancel, pause, skip a delivery, or change your subscription at any time through your account portal on our website, or by contacting us at info@aftergum.com. Cancellations take effect for the next billing cycle. Orders that have already been processed at the time of cancellation will be shipped and billed as scheduled.

Price changes. If the price of your subscription changes, we will notify you in advance at the email address associated with your account, and the new price will apply to subsequent billing cycles. Your continued enrollment after notice of a price change constitutes acceptance of the new price.

Confirmation. After you enroll in a subscription, we will send you an email confirming the subscription terms, including the price, billing frequency, and instructions for cancellation.

All subscription sales are final in accordance with Section 5 (Shipping; All Sales Final). Cancelling or skipping a subscription does not affect orders that have already been processed or shipped.

5. Shipping; All Sales Final

We currently ship within the United States only. Shipping timelines and fees are listed at checkout and on our Shipping Policy page. Delivery estimates are not guarantees, and we are not responsible for delays caused by carriers, weather, or other events outside our control.

Because our products are food items, all sales are final. We do not accept returns or offer refunds for reasons of preference, taste, or change of mind, and products cannot be returned for health and safety reasons.

If your order arrives damaged or defective, or if you receive an incorrect item, email info@aftergum.com within 7 days of delivery with your name, order number, and a photo of the issue. We will send a replacement or issue a full refund, including original shipping, at no cost to you. Approved refunds are issued to your original payment method and may take 5 to 10 business days to process; your bank or card issuer may require additional time to post the refund.

6. Intellectual Property

All content on our website, including the aftergum® registered word mark, the registered aftergum tooth fairy logo, the “sip, chew, smile”™ tagline, and all other trademarks, logos, images, text, product designs, and packaging designs, is the property of Aftergum Inc. or its licensors and is protected by United States trademark, copyright, and other intellectual property laws. You may not use, copy, reproduce, distribute, or create derivative works from our content without our prior written permission.

7. User Conduct

You agree not to misuse our website or services, including by attempting unauthorized access, scraping or harvesting data, introducing viruses or other harmful code, impersonating another person, placing fraudulent orders, or engaging in any activity that interferes with the operation of our website.

8. Informational Content; Not Medical or Dental Advice

The content on our website, including blog posts, product descriptions, and educational materials, is provided for general informational purposes only and is not medical or dental advice. It is not a substitute for professional advice, diagnosis, or treatment from a qualified dentist, physician, or other healthcare provider. Always consult your dentist or healthcare provider with any questions about your oral health, and before use if you are pregnant, nursing, taking medications, or have a medical condition. aftergum® products are not a replacement for brushing, flossing, or routine professional dental care.

9. Product Availability and Local Restrictions

Our products may not be available in all locations. It is your responsibility to ensure that purchasing or consuming our products complies with the laws and regulations applicable to you.

10. Warranties Disclaimer

Our products and website are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties and guarantees, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

11. Limitation of Liability

To the fullest extent permitted by law, Aftergum Inc. and its officers, directors, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or relating to your use of our website or products. To the fullest extent permitted by law, our total liability for any claim arising out of or relating to these Terms or our products shall not exceed the amount you paid to us for the product giving rise to the claim. Some jurisdictions do not allow the limitation of liability for certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Aftergum Inc., its officers, directors, employees, contractors, and affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your misuse of our website or products, your violation of these Terms, or your violation of any rights of a third party.

13. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Before filing any formal claim, you agree to first contact us at info@aftergum.com and give us a good-faith opportunity to resolve the dispute informally within 30 days. Any dispute that cannot be resolved informally shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the Effective Date at the top of this page. Your continued use of our website or purchase of our products after any changes constitutes your acceptance of the revised Terms.

16. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and Aftergum Inc. regarding your use of our website and purchase of our products.
